I have received a summons what should I do?

I HAVE RECEIVED A SUMMONS

The costs of £45 that are shown on your summons have already been added to you account. A further £20 charged will be added to your account when your cases is heard at court unless the whole amount owed (including the £45 costs) is paid before the court date, in which case all further recovery action will be stopped.

You can make a payment over the telephone by calling (0300 7900 215 - option 1), online at Pay Your Bills Online, via online banking, by visiting one of our offices or at the Post Office.

Please note that cheques will not be accepted unless they are received at least 7 days before the hearing.  Please also allow for extra days if you are paying via the bank or Post Office as it can take up to 7 days for us to receive these payments.

Detailed below are some questions often asked by Council Tax payers

 

WHY HAVE I BEEN SUMMONSED?

Because the Council says it has not received the appropriate amount from you.

 

I DISPUTE THAT I OWE THE AMOUNT STATED.  WHAT CAN I DO?

Contact the Revenues Team before the Court Hearing.                                                                                                                                                                                         

I AGREE THAT I OWE THE AMOUNT, BUT CANNOT PAY BEFORE THE COURT HEARING.  DO I HAVE TO GO TO COURT?

No, but at the Hearing the Council will request a Liability Order in your absence and a further £20 costs will be charged. You should contact the Revenues Team immediately to discuss a payment arrangement.

 

WHAT IS A LIABILITY ORDER?

An order signed by a Magistrate allowing further recovery action to proceed. This may include the use of bailiffs, deductions from your salary or benefit and ultimately committal action.

 

WHAT SHOULD I DO IF I CAN'T AFFORD TO PAY?

Contact the Revenues Team immediately on 01237 428900 to discuss a suitable payment arrangement.

 

If you are intending to attend court, then the council does offer the opportunity for personal interviews with members of the Revenues Team on Thursday and Friday before the court hearing - if you wish to take advantage of this facility please contact 01237 428900.

Torridge District Council would like to invite anyone within the district who feels that they are on a low income and are having difficulty paying their Council Tax, to apply now for Council Tax Support.

 

You can get an application form by contacting the Benefits Team on 01237 428700, or by collecting a claim form at any of the Council's offices in Bideford, Holsworthy.
